Whatever Floats your Boat - Riparian Boundaries

Waterways are some of the oldest transportation corridors in our country. This class begins with a discussion of the public trust doctrine and continues with the evolution of the present definitions of "Navigable Waterways" with relevant state-specific case law and statutes. Significant U.S. Supreme Court rulings from early formative decisions to the present day will be considered. Ownership of the fee, Rights of navigation and limits of regulatory authority (including U.S.A.C.E. definitions) are considered, along with a discussion of accretion, erosion, and avulsion.  A segment on interpreting riparian land descriptions will also be included.
