TWO HALF-DAY SESSIONS:
The morning session, "Dealing with Undescribed Rights of Way" explores the numerous occasions when easements are created without a definition of location or width. A review of evidence and past court decisions offers tools with which to answer those questions. This half-day presentation will include a review of what is an easement, types of easements, creation and termination of easements, along with researching and locating them.
The afternoon session, "Picking up the Pieces - Dealing with Changes in Technology" examines the changes in technology, practice and standards. In evaluating past practice, and the evidence therefrom, there must be an understanding of how to compare yesterday’s work with today’s. When things differ, or don’t seem to meet today’s requirements, what should be done will depend on the nature of the problem and the circumstances of the activities, based on the rules in effect.
